A former security guard, who sexually assaulted a Class 4 student in 2016, has had his application for enlargement of time for leave to appeal against sentence granted.
However, the Appeals Court refused the convict’s appeal against conviction.
The man, who was found guilty of three counts of rape and two of sexual assault, was sentenced last year to 14 years and 10 months with a non-parole period of 12 years and 10 months.
Court records show he sexually abused the girl when her parents were at work on several occasions between 2016 and 2017.
Justice Alipate Qetaki concluded the appeal against conviction had no prospect of success, while the sentence was arguable and had merit.
