The Government has confirmed it will not appeal the recent High Court decision in relation to Barbara Malimali.
In a statement, the Government acknowledged the ruling and expressed appreciation to the Judiciary for what it described as careful and independent adjudication of the matter.
Following legal advice and consultations with President Ratu Naiqama Lalabalavu, the Government said it had decided not to challenge the High Court’s decision.
“While the decision that was subject to judicial review was made on the basis of legal advice provided by a learned King’s Counsel, the Government fully respects the ruling of the Court,” the statement said.
The Government noted that the ruling highlights the important role of the Judiciary in upholding justice and fairness for citizens, while reinforcing the strength of Fiji’s legal framework and the separation of powers.
It also acknowledged the constitutional mandate of the Judicial Services Commission (JSC) to deliberate on the matter and bring it to its conclusion, as outlined in the court ruling.
Prime Minister Sitiveni Rabuka reaffirmed the Government’s confidence in Fiji’s democratic institutions, adding that the administration remains committed to good governance, accountability, judicial independence and the separation of powers among the Executive, Legislature and Judiciary.
