Fiji Court refuses stay of execution of US warrant to seize Amadea

The High Court in Suva yesterday refused an application by Millemarin Investments Ltd for an interim stay of execution of the court’s order granted to the Director of Public Prosecutions (DPP) on Tuesday early this week.

The DPP had filed an application seeking orders:

  • that the motor yacht Amadea be restrained from leaving Fijian waters until the finalisation of an application to register a warrant to seize the property, and
  • that a US warrant to seize the Amadea be registered.

The High Court had earlier granted the application to restrain Amadea from leaving the Fijian waters and on Tuesday, May 3, Justice Deepthi Amaratunga granted the second application to register the US warrant to seize the super yacht.

According to the DPP, on Thursday, May 5, the Fijian Police served the court order on the captain of the Amadea, and the yacht was then handed over to United States authorities.
