The Employment Relations Court has ruled it has no powers to rule on any laws made between December 5, 2006, to October 6, 2014.

Justice Anjala Wati made the ruling in a February 16 judgment in a case where a University of Fiji employee challenged the termination of his employment.

Vijay Kumar was employed as the Human Resources Manager at the university, an institution established under the University of Fiji Act 2011.

Justice Wati ruled under section 173 (4)(d) of the Constitution of Fiji, no courts in Fiji had the powers to hear and make decisions of any law that was enacted between December 5, 2006, to October 6, 2014.

“It is very clearly spelt out in the above section that the laws that come within the ambit of the above provision are the laws made between December 5, 2006 and the first sitting of Parliament (October 6, 2014),” stated Justice Wati.
