10-year jail term for rapist

A 22-year-old convicted of raping his then 12-year-old cousin will serve seven of his 10-year jail term before he can be considered for parole.

The father of a four-year-old boy, who also has a partner who’s presently pregnant with his second child, was sentenced on Wednesday at the High Court in Suva.

Court records show that on November 13, 2022, the girl was at her grandparents’ house where the accused was also staying at the time.

In the early hours of the night when the complainant fell asleep, he proceeded to commit the offence. She then fled the house after the accused had gone to his room.

The next day the young girl reported the assault to her teacher who then alerted the police.

“(She) was only 12 years old and would have felt safe sleeping over at her grandparents’ home. She should have been safe. You took advantage of her young age,” Justice Dane Tuiqereqere said in his ruling.

“She was a mere child, and no doubt looked up to you for protection. You violated her trust.

“(She) should have not been exposed to sexual activity at such a young age. You have robbed her of her innocence and her childhood.

“I have no doubt that your offending will have long-term psychological consequences on (her), not least on her ability to trust male figures in her life, including her own family.

“The courts have been mindful to show some leniency for young first offenders. The court must leave the door open for your rehabilitation.”

It was also revealed the accused has been receiving ongoing treatment for his serious medical condition.

Justice Tuiqereqere imposed a domestic violence restraining order and standard non-molestation and non-contact conditions on the accused.

The Fiji Corrections Service has also been directed to ensure the accused has access to treatment.
