Judge expresses displeasure over commission’s non-appearance

Justice Dane Tuiqereqere has expressed displeasure at the Legal Aid Commission’s non-appearance despite being directed to act as a “friend of the court” for alleged murderer Apisai Madigibuli.

At the last occasion, the commission was directed to provide legal assistance to Mr Madigibuli in preparation for the 2026 trial.

The 30-year-old’s trial, which was scheduled to start from mid-July to August this year, was vacated because Mr Madigibuli wanted to represent himself.

Despite being cautioned by the judge about the severity of the charge and the challenges he would face during trial, Mr Madigibuli remained firm in his decision.

Given that it was his right, the judge said he hoped the accused would change his mind to ensure his rights were properly protected.

Meanwhile, the accused is also seeking the court’s approval to have his voir dire hearing redone because he claims his instructions to the commission at the time were not followed.

The court had found Mr Madigibuli’s confessions in the caution interview admissible in an earlier voir dire conducted and ruled last month.

Justice Tuiqereqere said he would need to think about it because of his concern regarding Mr Madigibuli’s legal knowledge, taking into account his rights.

Mr Madigibuli has filed another bail application, but prosecutor Monisha Naidu submitted that there was no change of circumstances and would, therefore, object to bail.

The trial has been rescheduled for April 6 to 17, 2026.

The case has been adjourned to August 26 for a hearing on bail.
