THE Judicial Services Commission met yesterday to assess its position and map out contingency plans ahead of pending court decisions involving the appointments of the acting and former FICAC commissioner.
Speaking to the media, Chief Justice and JSC chair Salesi Temo said the commission was considering a range of scenarios depending on how the courts ruled.
Mr Temo said the JSC would ultimately be guided by the courts, noting that any final decision would depend on the outcome of ongoing legal proceedings.
“Our recommendation to His Excellency on (Lavi) Rokoika is still on hold, until we consider what the Court of Appeal will say in (Barbara) Malimali’s case, and Justice Bull makes a ruling,” he said.
Mr Temo noted that the legal process could involve further appeals, underscoring the need for the commission to remain flexible.
“But I have plan in my head right now to tackle whatever situation that arises.”
The JSC indicated it remains open to dialogue between parties involved in the matter, despite the case being before the courts.
Lawyers, including Prime Minister Sitiveni Rabuka’s lawyer Simione Valenitabua and the Attorney-General’s Office were invited but did not attend.
Only Ms Malimali’s lawyer Tanya Waqanika was present.
