Ashton-Lewis adjournment hearing set for today

Justice David Ashton-Lewis’s application to adjourn the April 10 substantive hearing of judicial review applications, in which four high-profile individuals are challenging the validity of the Commission of Inquiry (COI) report, will be heard today.

The matter was called yesterday before Justice Dane Tuiqereqere. The court was informed that Justice Ashton-Lewis is facing a medical issue and is seeking a later hearing date, as he intends to be in Fiji for the hearing once he has recovered. Justice Ashton-Lewis was the Commissioner of the COI.

The judicial review applications have been brought by former Fiji Independent Commission Against Corruption Commissioner Barbara Malimali, Fiji Law Society president William Wylie Clarke, Fiji Law Society’s immediate past president Laurel Vaurasi, and former attorney-general Graham Leung.

The four are seeking court orders to quash both the findings and recommendations made by Justice David Ashton-Lewis in his COI report, along with other related declarations.

The hearing is set for 2.30 pm.
