State opposes bail for murder accused

The High Court in Lautoka was yesterday told the person charged for the murder of prominent Nadi physician, Dr Isireli Biumaitotoya was not a man of integrity and could not be trusted.

Prosecutor Joeli Nasa said this when Ratu Peceli Rosotokaicake Rokoravolo appeared at his bail hearing before Justice Aruna Aluthge.

The murder is alleged to have occurred between August 31 and September 1 last year.

Mr Nasa told the court that Mr Rokoravolo had seven previous convictions, six of which remained active.

The prosecution is alleging that the accused and Dr Biumaitotoya were in a domestic relationship and shared a residence at the doctor’s home.

Pushing for bail, Mr Rokoravolo’s lawyer Edwin Wainiqolo submitted that his client had already spent more than seven months in remand, was prepared to adhere strictly to any bail conditions and would not reoffend.

He also refuted claims by the State that his client was in a partnership with Dr Biumaitotoya and asked the court for additional time to prepare for voir dire (“trial within a trial”) proceedings about which evidence should be admitted in the trial.

Justice Aluthge has adjourned the matter to April 10 for a ruling on the bail application.
