High Court to Rule on Waqanika Stay Application May 6

The High Court in Suva is set to deliver its ruling on Suva Lawyer Tanya Waqanika permanent stay application on May 6.

The hearing of her application concluded today before Justice Siainiu Fa’alogo Bull. Ms Waqanika seeks to have her criminal charge instituted by the Fiji Independent Commission Against Corruption in the Suva Magistrate’s Court be permanently halted.

She is challenging the validity of Lavi Rokoika’s appointment as Acting FICAC Commissioner.

Ms Waqanika is facing a count of publicly indicating opposition to a political party, contrary to section 14 (7) of the Political Parties (Registration, Conduct, Funding and Disclosures) Act 2013, read with Section 14 (1) (d).

FICAC alleges that on April 19 last year, Ms Waqanika, being a public official, namely a board member of Investment Fiji and Telecom Fiji Ltd respectively, publicly indicated opposition to SODELPA by posting opposing comments about the party on her Facebook post.

Her case in the lower court is presided over by Magistrate Yogesh Prasad. She is represented by Lawyers Barbara Malimali and Samuela Savu.

Prosecution is led by Ms Lavi and Senior Prosecutor Joseph Work.
