Parties linked to the removal of former FICAC Commissioner Barbara Malimali are expected to meet in Suva today as the Judicial Services Commission (JSC) weighs compliance with a High Court ruling declaring her dismissal unlawful.
Ms Malimali’s lawyer Tanya Waqanika confirmed the meeting yesterday.
Last month, the JSC pledged to take “all necessary steps” to resolve matters concerning Ms Malimali on or before March 31. The commission had earlier convened to consider Justice Dane Tuiqereqere’s ruling, which found that
Ms Malimali’s removal by the President, acting on the advice of the Prime Minister, was unlawful.
Those invited to today’s meeting included Ms Malimali and her lawyer, Solicitor-General Ropate Green representing the State, and Simione Valenitabua for the Prime Minister.
Following consultations, the JSC, in discussion with Acting Attorney-General Siromi Turaga, is expected to make independent recommendations to the President.
In his judgment, Justice Tuiqereqere said the JSC must also consider the appointment of Lavi Rokoika as acting commissioner, noting the court lacked jurisdiction to determine the validity of that appointment.
