21 years for indecent assault

A man convicted of sexually and indecently assaulting his 10-year-old daughter has been jailed for 21 years with a non-parole period of 13 years and two months.

Court records show the victim, who is the eldest of four children, was preparing to go to church with her mum on August 6 when her 35-year-old dad complained of leg pain, so she stayed home with him and her brother.

After their mother left for church, the man sent his son to bring Panadol and oil from his grandfather’s place before calling his daughter into his room.

Lying on the bed, he told her to come close to him before committing the offence. She cried but her father told her not to because he was her father.

The girl did not tell her mother or her brother of the incident because her father told her not to do so.

At a later date, the man came home from a party and told his wife that he was feeling hot before sleeping in the victim’s bedroom where he committed the offence again.

The following morning her mother felt something was wrong and enquired with her after which the girl confessed that her father had touched her.

In his ruling on November 19, Justice Lee James Burney said: “I would encourage you to reflect at length on the inevitable harm that your offending has caused to your daughter, and your other children, and to engage with any intervention programs that may be available to you during your period of incarceration.”
