A suva lawyer told the High Court in Suva yesterday that he was confused about the allegations made against his client.
Karl Jamnadas is representing Ashneel Nath, an Occupational Health and Safety (OHS) inspector, who was charged for the death of a woman who fell from a Ferris wheel in Suva in 2023.
Mr Nath made his first appearance in court yesterday charged with one count of manslaughter arising from breach of duty.
His lawyer informed the court they are confused about the allegations because the summary of facts is unclear, illegible, and inconsistent. Mr Jamnadas said he had expected the State to appear and clarify the issues raised, however, prosecutors were away at a conference in Nadi.
He said he had raised the same concerns in the lower court, noting that he had received minimal information and that the charge was defective and lacked necessary particulars.
Justice Daniel Goundar has given the State until January 9 next year to file full disclosures, after which Mr Nath will have one month to prepare for a plea.
Bail was extended and the case adjourned to February 23.
