Tenant told to vacate

THE High Court in Suva has ordered a tenant occupying a flat in Nasinu to vacate it on or before November 10 following a number of misconduct and breaches of tenancy.

Property owner Rajnesh Narayan had sought an order for immediate vacant possession of land located on Nokonoko Rd, Laucala Beach, Nasinu, against his tenant, Mohammed Imran Raza, who occupied one of the four flats.

Records of proceedings show that since the commencement of Mr Raza’s occupation with his spouse in May this year, he has persistently defaulted on or delayed payment of rent and electricity charges and failed to execute a formal written tenancy agreement, despite being provided with a copy.

Mr Narayan further alleges a pattern of misconduct by the defendant, including the allowance of unauthorised visitors onto the premises, and repeated violent or disorderly behaviour while intoxicated.

There were also detailed incidents of property damage.

Mr Narayan said he personally served Mr Raza with a notice to vacate the property but he refused.

In reply, Mr Raza denied the allegations made against him by Mr Narayan.

However, Justice Daniel Goundar found Mr Raza had engaged in misconduct involving abusive behaviour, property damage, and disturbance to Mr Narayan’s family and elderly parents and subsequently gave the order to vacate the property.
