THE High Court in Labasa has convicted a man for stealing mobile phones and $6000 cash in April last year.
Joji Nasedra, Solomone Boneseva, and Varinava Namumu were jointly charged with two counts of aggravated robbery. However, Nasedra was found guilty while Boneseva and Namumu were acquitted.
Court records show Nasedra and others attacked the two victims before tying their legs and wrists, while other occupants of the house locked themselves in the bathroom.
The prosecution relied on circumstantial evidence because no one could identify the intruders.
“It is also immaterial that the prosecution was not able to prove the identity of the other robbers,” said Judge Justice Lee James Burney in his judgment issued on September 26. “I am sure that (Nasedra) acted with other persons unknown.”
Nasedra has 30 days to appeal to the Court of Appeal.
