Key witness to testify in open court amid social media scrutiny concerns

The Master of the High Court in Lautoka, Preetika Prasad, will be giving evidence in open court in the case of former attorney-general Aiyaz Sayd-Khaiyum and former supervisor of elections Mohamed Saneem.

This decision follows Chief Justice Salesi Temo reviewing his initial decision after asking Acting DPP Nancy Tikoisuva on the significance or harm caused by Ms Prasad’s evidence, prompting her to explain her reasons for requesting it to be heard in closed court.

Ms Tikoisuva cited Ms Prasad’s current position and vulnerability to social media scrutiny as the primary reasons for her request.

She further highlighted that state witnesses in this case had been subjected to ridicule and victimisation on social media over the past week.

Chief Justice Temo reminded the public that while he values free speech, it must be exercised responsibly and without jeopardising the judicial institution.

He emphasised that individuals who unlawfully malign others will face legal consequences such as contempt of court.

In this case, Ms Prasad was the former acting solicitor general and former secretary to the COC.

He said having rights comes with responsibility.
