Magistrate recuses himself from case

Suva Magistrate Charles Ratakele has stepped down from presiding over the case of a self-employed man accused of unlawfully importing 4.7 kilograms of liquid methamphetamine.

Eroni Kitanimati, 37, of Suva, appeared before Mr Ratakele, who declared a conflict of interest as he is a close relative of the accused. Consequently, he recused himself to prevent any inference of bias.

Mr Kitanimati is alleged to have committed the offence between September 11 and 12.

The case is linked to another case called earlier this week involving two police officers charged with the same offense and the court was told the charges would be consolidated.

Jagath Karunarate, for the accused, requested bail, but prosecutor Sergeant Lata opposed on the grounds of public interest.

The case is scheduled to be brought before Chief Magistrate Josaia Waqaivolavola on October 1.
