Supreme Court to deliver ruling on Constitution reference this Friday

The Supreme Court of Fiji is set to deliver its ruling on the high-profile constitutional reference brought by the Cabinet on Friday at 2:30pm.

.The case centres on legal questions posed by the Cabinet regarding Fiji’s 2013 Constitution.

It was specifically on the validity and legal status of provisions that prevent any amendment to the Constitution without a referendum, and whether the 1997 Constitution remains legally in force.

In its original reference, the government sought the Court’s opinion on whether certain parts of the 2013 Constitution, particularly the so-called “unamendable provisions”, could be legally challenged or modified.

It also asked the Court to clarify whether the 1997 Constitution still holds legal authority or if it was lawfully abrogated following the 2006 coup and subsequent developments.

Friday’s ruling is expected to carry major legal and political implications for Fiji’s constitutional order, potentially affecting future governance, electoral processes, and judicial interpretation of the country’s supreme law.
