THE ruling on an injunction application filed by the counsel of ousted Nadi Chamber of Commerce and Industry president Dr Ram Raju’s to prevent current president Lawrence Kumar from acting in the position will be made on Thursday.
The matter was heard before Justice Sekonaia Vodokisolomone in the High Court in Lautoka today.
Arunesh Achal of Zoyab Legal represented Dr Raju on the instructions of principal counsel Anil J Singh while Elvis Dass represented defendants, NCCI interim secretary Shalendra Prasad, Mr Kumar and the NCCI.
Justice Vodokisolomone recommended the matter proceed to hearing on the originating summons.
He said this did not mean he was granting the interim injunction; however, the issue was that these office bearers would be stepping down while work is going on in Nadi.
The court heard there were similarities in the originating summons and the injunction application.
Mr Dass said costs would be sought if the plaintiff’s counsel were to withdraw the application.
Mr Achal requested the matter be stood down so he could discuss the next course of action with Mr Singh.
He later told the court that Mr Singh requested the ruling be made on the interim injunction application.
Mr Achal said Mr Singh wanted a ruling made on the application and the substantive matter, however, Mr Dass said the substantive application did not have a supporting affidavit.
Justice Vodokisolomone will deliver his ruling on Thursday.
