THE High Court in Suva has granted former FICAC Commissioner Barbara Malimali’s leave to apply for Judicial Review challenging the legality of her termination.
Justice Dane Tuiqereqere delivered his ruling this morning.
The court has also ordered that Ms Malimali is entitled to cost of $1500 to be paid by the respondents.
Appearing for the applicant was lawyer Tanya Waqanika.
While the Deputy Solicitor Eliesa Tuiloma, Senior Legal Office Pauliasi Nawaikula and Principal Legal Officer Geraldine Naguilevu.
The case is being brought under Section 5 of the FICAC Act 2007, Section 44 of the Interpretation Act 1967, and Sections 16, 81, 82 and 112 of the 2013 Constitution of the Republic of Fiji.
The case has been adjourned to July 28.
