Man in remand seeks bail

A MARRIED man seeking bail because of the fear of being remanded with HIV infected individuals has not provided enough details to substantiate his claims.

The man, who is accused of raping a woman in her 20s during a massage session, had his bail hearing before High Court judge Justice Pita Bulamainaivalu.

His Legal Aid Commission lawyer said the man was not able to give more in-depth information because of the impact or repercussions it might have on him as a remandee.

The former employee of a Lami supermarket is alleged to have raped a work colleague in her home on November 1, 2023.

Court records show the woman, who had suffered back and stomach pains, had known the accused as a masseur and asked for his professional services.

However, while massaging the woman, he allegedly began to touch her inappropriately.

When she questioned him, he allegedly told her not to worry and that it was a matter between them.

He is then alleged to have proceeded to have unconsented, forceful sexual intercourse with her. The victim allegedly tried pushing him away but was unsuccessful and subsequently fainted.

After the accused left, she called her boyfriend and told him about the alleged incident.

The accused has denied the allegations, claiming nothing happened between them.

His lawyer argued that he was being pressured by other remandees to share needles despite his countless refusals.

However, State lawyer Unaisi Ratukalou argued that as per the statement of an officer in charge of the remand centre, the accused has not even once raised an issue, and if he did, corrections would have investigated and facilitated a remedy.

Ms Ratukalou, in her conclusion, stated that if the life of the accused was in danger, then he needs to be bold enough to detail the specifics of his claims.
