THE Fiji Broadcasting Corporation (FBC) and its former CEO Riyaz Sayed-Khaiyum’s summons on assessment of damages against former MP Niko Nawaikula has been withdrawn.
Mr Nawaikula appeared before Acting Master Liyanage Kashyapa Wickramasekera at the High Court in Suva yesterday.
Mr Sayed-Khaiyum sought relief in the form of general damages, special damages and loss of business revenue and profits for FBC.
This included punitive damages, a permanent injunction restraining the further dissemination of the statements, interest on all sums awarded, and costs on a full indemnity basis.
The summons for assessment of damages was filed on December 9, 2022.
Defence lawyer Gul Fatima informed the court their client has wished to terminate the summons for assessment of damages filed following a Court of Appeal decision in 2022.
Ms Fatima said the current state of this matter was that the Supreme Court had overturned the Court of Appeal decision.
