Plea deferred for trio charged with manslaughter

Three men who allegedly assaulted a bus driver resulting in his death appeared at the High Court in Suva today.

The matter was called before High Court judge Justice Aruna Althuge in Suva for a plea.

Mikaele Lawaniyale, Isikeli Lagibalavu and Josateki Rokodakunivosa are facing charges of one count each of manslaughter.

Mr Rokodakunivosa’s lawyer Talei Kean raised an issue on how the counts were listed in the information and requested if the State could include all counts together in one charge.

In response, State lawyer Setafano Komaibaba told the court that all three men were charged with manslaughter and they had committed the offences in different ways and that was the reason why the counts had been separated.

He told the court that all men were not acting on joint enterprise.

It is alleged the men assaulted the bus driver who later died because of the injuries he sustained during the alleged incident.

The alleged incident took place on October 3 at the Nausori bus station.

All three are on bail.

The matter has been adjourned to December 8, 2020, for a plea.
