The hearing on the three motions raised by the former supervisor of elections Mohammed Saneem commenced today before Suva Magistrate Yogesh Prasad.
The motions raised by the former SOE include the validity of charges sanctioned by then-acting DPP John Rabuku, breach of fundamental human rights, and the Electoral Act under which FICAC had powers to investigate and prosecute him.
Mr Saneem is facing a charge of receiving a corrupt benefit through the receipt of deductible relief in the sum of $55,944.03 as back pay from then attorney-general, Aiyaz Sayed-Khaiyum.
Appearing for the former SOE was prominent Suva lawyer Devanesh Sharma and the Acting Director of Public Prosecutions Nancy Tikoisuva for the state.
Meanwhile, the consolidation of charges sought by the prosecution relating to Mr Sayed-Khaiyum has been put on hold until Mr Saneem’s issues are resolved.
The former A-G is separately charged with a count of abuse of office.
Magistrate Prasad told the court that a ruling will be delivered next month.
