‘Affidavits misleading, incomplete’

THE lawyer representing the Supervisor of Elections, Sharvada Sharma, told the Court of Disputed Returns that the 11 allegations in the petition against the results of the 2018 General Election weren’t served with evidence.

While making his submissions yesterday, Mr Sharma said the petition was filed with only two affidavits, adding it was misleading and incomplete.

The case of Sitiveni Rabuka and Professor Biman Prasad against Voreqe Bainimarama was called before Madam Justice Anjala Wati and Justice Kamal Kumar in Suva yesterday.

Mr Sharma said the Supervisor of Elections could answer some of the allegations.

“The petition is incomplete and misleading because it was not served with the affidavits.

The Supervisor of Elections was served around 5.47pm yesterday (Monday) that has put us in a difficult position,” he said. Mr Sharma said the entire petition should be struck out because it was misleading.

The court also heard that former FijiFirst member of Parliament Faiyaz Koya was also listed as one of the respondents.

In response, the lawyer for the petitioners, Filimoni Vosarogo, said the petition indicated the petitioners intention to file further affidavits which were to be ready today. However, in its ruling yesterday afternoon, the court declined the petitioners the right to file further affidavits.
