Accused withdraws bail application

The accused appeared before Justice Pita Bulamainaivalu in the High Court in Suva.

An unemployed man accused of raping his wife has withdrawn his third bail application.

The 35-year-old man, who’s married and has two children, appeared before Justice Pita Bulamainaivalu charged with a count each of rape and assault.

It is alleged the accused raped his 43-year-old wife while their children were present at their residence. The alleged incident occurred on July 15 last year.

The scheduled trial date from January 27 to 31 next year has been vacated because Justice Bulamainaivalu has a month-long trial in Labasa.

State lawyer Zenith Zunaid told the court of minor issues concerning the admitted facts which require amendment.

Justice Bulamainaivalu directed both parties before the next court date to consult each other on the present issues.

Meanwhile, the accused’s lawyer from Legal Aid told the court the accused wished to withdraw his current bail application.

The accused has been remanded in custody and the case adjourned to December 12.
