A father accused of committing sexual crimes against his biological daughter has been convicted.
Lautoka judge Justice Sunil Sharma’s judgment in the case was for two counts of sexual assault, and a count of rape for the incident that occurred last year and this year.
Court records showed the accused had raped his daughter on two occasions at her grandmother’s house.
The first incident occurred when the complainant was on her way out of the washroom and she had later told her mother that her father was harassing her inside the toilet.
On another occasion, the accused was sleeping with her eldest sister and her two brothers when her father raped her again.
The matter only came to light when her eldest sister caught the father in the act.
“I reject the defence of denial by the accused as not plausible on the totality of the evidence,” Justice Sharma said in his ruling.
“The defence assertion that the accused had not done anything to the complainant is unworthy of belief.
“I do not accept the accused did not do anything to the complainant and that the allegations are a concocted story by the complainant’s aunt.
“The act of the accused has some elements of indecency that any right-minded person would consider such conduct in nature.”
