Update: 2:54PM THE Public Centre for Public Integrity has written to the Office of the Legal Commissioner in Melbourne, Australia complaining against High Court judge Jocelyn Scutt.
Dated March 12, 2008, the letter is addressed to the Legal Services Commissioner Victoria Marles.
In the letter, PCPI executive director Angie Heffernan said the organisation had actively campaigned for the independence and integrity of the countrys judiciary and legal systems.
She said her complaint against Ms Scutt was based on that issue.
Ms Scutt is a member of the Victoria Bar Association and was appointed a puisne judge in November last year.
She said the appointment did not comply with the Constitution and would therefore be part of the Fiji Law Society's judicial review currently before the High Court.
Ms Heffernan said the Society was also questioning the legality of the Judicial Services Commission meeting in January last year which recommended the suspension of the Chief Justice Daniel Fatiaki and the appointment of Justice Anthony Gates to replace Mr Fatiaki on an acting capacity.
She said Ms Scutts appointment was questionable and asked for the support of the Melbourne Legal Commissioners Office in conducting an investigation into the professional conduct of Ms Scutt.
